Cooley’s Insurance & Reinsurance practice provides a full range of legal services to the global insurance and reinsurance industry and benefits from the extensive experience of our lawyers in this area. We provide full insurance & reinsurance services across Cooley’s broad client base, from advice regarding the negotiation and placement of policies, to assisting with claim presentation, negotiation and settlement, to litigating coverage and rescission claims for policyholders, insurers and reinsurers. In addition to our core services for insurance & reinsurance industry clients, we frequently draw upon the corporate, employment, litigation, securities, tax, banking, competition, intellectual property and financial services practices within our firm to meet all of our clients’ needs.

We have experience in assisting clients across the full spectrum of insurance and reinsurance eg third party liability, including commercial general liability, directors’ and officers’ liability, employers’ liability, professional indemnity, products liability, Bermuda Form and financial institutions; and first party insurance, including marine & energy, property, business interruption, cyber risk and more.

Our business insurance & reinsurance lawyers assist clients in structuring, drafting, negotiating and obtaining regulatory approval of operations and agreements, including unique and complex reinsurance arrangements. We represent parties in connection with significant equity investments by insurers and reinsurers, and in the formation, licensing, acquisition and sale of carriers, brokers and agents.

The group’s litigation insurance & reinsurance lawyers have represented leading companies in numerous (re)insurance arbitrations and court cases. Our lawyers have addressed all commonly recurring claims and coverage issues, as well as many unique market situations. While our team comprises skilled litigators who frequently receive verdicts in favor of our clients, we also assist clients in resolving disputes through alternative means, such as mediation and negotiation, and strongly encourage these alternatives wherever appropriate. We also assist companies in comprehensive reviews of contract wordings and developing treaty guidelines.

Our insolvency and run-off lawyers are well-known for acting on schemes of arrangement, recently completing the Minster scheme of arrangement, the largest insurance scheme to date and for acting in specific disputes in the run-off market.

The team’s diverse range of work means that we are familiar with the operation of the world’s principal insurance and reinsurance markets, whether in London, U.S., Bermuda, continental Europe or elsewhere.
